Where do you live in the USA? Where you are now living you can file for divorce without having to go back to India. The US states have pretty well now all adopted 'no fault divorce" so obtaining a divorce is relatively simple, especially if there are no children nor much property which it sounds like is your situation.

Divorce is granted in the no fault states for "irreconcilable differences" - meaning, there is no hope of our making a marriage work. The other party does not have to agree, either, if one is adamant they want out of the marriage. The court will grant it.
